People are increasingly worried about losing their privacy.

A 2026 survey by the CNIL, France's data protection authority, found that 67% of respondents believe smart glasses pose a risk to personal privacy, with specific concerns about consent, AI-enabled misuse such as deepfakes, and what happens to the data these devices capture.

The CNIL itself warns that the near-invisible nature of these devices can create a lasting feeling of being constantly observed, and has only just begun the work of deciding how to regulate them at a European level. That gap, between how fast the devices are shipping and how slowly regulation can move, is exactly what CloakDots is built to close now.

Regulators agree the gap exists. They are not fast enough to close it.

This is not only a French concern. The European Data Protection Supervisor has published its own technology report on smart glasses and data protection, and the European Data Protection Board, which coordinates data protection authorities across the EU, has separately commissioned a report into the social acceptability of these devices.

Members of the European Parliament have pressed the European Commission to clarify how existing rules, including the GDPR and the AI Act, apply to AI-enabled smart glasses. The process is real. It is also not fast, and the devices are shipping regardless.

American coverage tells the same story.

Forbes has reported that gyms have documented cases of members being filmed without consent through smart glasses, and separately covered Harvard research showing that AI running on the glasses themselves can surface someone's home address and phone number within seconds of looking at them.

Forbes's own conclusion: “legislation hasn't kept pace. Most privacy laws predate this tech, and U.S. regulations are patchy.” Coverage of the current generation of AI smart glasses has also pointed to Illinois' Biometric Information Privacy Act, one of the only U.S. laws that treats a person's face as data a private company cannot capture without consent, as one of the few real legal guardrails currently in place.
